Updated Coaching Terms & Conditions
1. Understanding
1.1 These Terms and Conditions apply to all coaching and mentoring services provided by Amit Sodha (Unlimited Choice Ltd) (hereafter referred to as “AS”) to any individual or organisation (the “Client”). This constitutes a binding contract between AS and the Client.
1.2 The term “coaching” in this agreement refers to all forms of personal, life, executive, business, dating, relationship, transformational coaching, and mentoring services provided by AS.
1.3 Coaching is not a substitute for professional mental health care, medical care, or therapy. AS does not diagnose, treat, or cure any psychological, medical, or psychiatric conditions.
1.4 By engaging in the coaching services, the Client agrees to abide by these terms. The Client acknowledges that coaching is a collaborative process, and its success is largely dependent on their commitment and participation.
1.5 The contract begins when the first session takes place, or when the Client explicitly agrees via written confirmation (WhatsApp, text, or email).
2. Responsibilities & Commitment
2.1 AS commits to providing professional and ethically guided coaching services aimed at helping the Client identify and achieve their personal and/or professional goals.
2.2 The Client is solely responsible for their decisions and actions. AS accepts no liability for any financial, emotional, physical, or personal consequences that arise from the Client’s choices.
2.3 AS does not guarantee any specific results, as coaching outcomes depend on the Client’s commitment, circumstances, and efforts.
3. Confidentiality & Data Protection
3.1 All information shared in coaching sessions is strictly confidential and will not be disclosed to any third party without the Client’s explicit written consent, except where required by law.
3.2 AS reserves the right to break confidentiality if:
- The Client discloses intent to harm themselves or others.
- There is a legal obligation to disclose (e.g., criminal activity, court order).
3.3 The Client’s data will be stored securely and processed in accordance with the UK Data Protection Act 2018 and the UK GDPR.
3.4 The Client will be required to provide an emergency contact, which will only be used in case of medical emergencies during coaching.
4. Coaching Sessions & Procedures
4.1 Scheduling: Coaching sessions are scheduled in advance, either individually or as part of a package. Sessions can be booked up to three months ahead.
4.2 Session Format: Coaching may be conducted in person, via Zoom, Skype, telephone, or other agreed methods. The Client is responsible for making contact at the agreed time unless otherwise stated.
4.3 Session Duration: Each session typically lasts 60 minutes, unless otherwise agreed upon.
4.4 Assignments & Follow-Ups: AS may assign tasks or exercises between sessions. While completion is optional, failure to engage in these may impact the Client’s progress.
4.5 The Client may contact AS via phone or email between sessions for brief clarifications. If additional coaching support is required, it may incur additional fees, which will be communicated in advance.
5. Fees, Payments & Refund Policy
5.1 Payment Terms: Full payment is required before the first session unless an alternative arrangement is agreed upon in writing.
5.2 Expiry of Prepaid Sessions: Any prepaid coaching sessions must be used within six (6) months from the date of payment. After this period, they will be forfeited without refund.
5.3 Refund Policy:
- If a Client cancels their coaching package after one session, they will receive a 50% refund of remaining fees.
- After two sessions, they will receive a 25% refund.
- After three or more sessions, no refund will be issued.
- Refunds do not apply to completed sessions.
5.4 Cancellation & Rescheduling:
- The Client must provide at least 48 hours’ notice to cancel or reschedule a session.
- If less than 48 hours’ notice is given, the session will be forfeited with no refund unless exceptional circumstances apply (e.g., medical emergency).
6. Termination of Coaching Contract
6.1 The Client may terminate the coaching contract at any time by providing written notice. Any outstanding payments will become due immediately.
6.2 AS reserves the right to terminate coaching services if:
- The Client behaves inappropriately, disrespectfully, or aggressively.
- The Client fails to adhere to payment agreements.
- AS identifies a conflict of interest or ethical concerns.
In such cases, AS will provide reasonable notice and issue refunds for any remaining prepaid sessions, unless termination is due to the Client’s misconduct.
7. Liability Disclaimer
7.1 AS is not responsible for:
- Any financial, legal, professional, or medical decisions the Client makes.
- Any indirect, incidental, or consequential damages resulting from coaching.
- Coaching outcomes, as they depend on the Client’s participation.
7.2 Coaching does not replace professional services from lawyers, medical practitioners, therapists, or financial advisors.
7.3 The Client accepts full responsibility for their actions and well-being.
8. Governing Law & Jurisdiction
8.1 These Terms and Conditions are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the UK courts.
8.2 If any provision in this agreement is found to be invalid or unenforceable, the remaining provisions will continue to apply.
